These Terms of Use ("Terms") govern your use of mediatoolnest.com and the tools available on it (together, the "Service"), operated by MediaToolNest ("we", "us").

By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

MediaToolNest provides free online tools to convert, compress, trim and extract video and audio files. The tools process files directly in your browser, on your own device. If a tool ever processes files on our servers, its page will say so. How we handle your files is explained in our Privacy Policy.

The Service is free and does not require an account. We may add, change, limit or remove tools or features at any time.

2. Eligibility

You must be at least 13 years old to use the Service, or older if your country requires a higher minimum age to use online services without parental consent. If you are under the age of majority where you live, you must have permission from a parent or legal guardian.

3. Your files and your responsibility

You keep all rights to your files. We do not claim any ownership of the files you process or of the results.

We don't receive your files. Files are processed on your device and are not uploaded to us. If we introduce a server-based tool in the future, you will grant us only a limited, temporary permission to process your file to provide the result you requested, as described in our Privacy Policy.

You must have the right to process your files. By using the Service, you confirm that you own the files you process or that you have all the permissions needed to convert, modify and download them. Laws on copying and format conversion differ between countries; you are responsible for complying with the laws that apply to you. See our Copyright Policy.

4. Acceptable use

You agree not to use the Service to:

  • process content that infringes copyright, trademarks or other rights of others;
  • process, create or distribute illegal content, including any content that sexually exploits or endangers children;
  • process content for the purpose of harassing, threatening, defaming or violating the privacy of any person;
  • circumvent digital rights management (DRM) or other technical protection measures;
  • upload malware or files designed to damage, disrupt or exploit our systems or the software we use;
  • bypass or attempt to bypass file-size, duration, rate or other usage limits;
  • access the Service through automated means (bots, scripts, scrapers) or use it for bulk or commercial-scale processing, except through a service we may explicitly offer for that purpose;
  • probe, scan or test the vulnerability of our systems, or interfere with the Service or other users;
  • resell, frame or offer the Service as your own, or use it to build a competing service;
  • use the Service in any way that breaks applicable law.

We may report illegal content to the appropriate authorities where required or permitted by law.

5. Usage limits

Each tool has limits, such as a maximum file size, which are shown on the tool page and may change. Because processing happens on your device, speed and the largest file you can process also depend on your device, browser and available memory.

6. Availability

We aim to keep the Service available and working correctly, but we do not guarantee that it will be uninterrupted, error-free or available at any particular time. We may suspend the Service for maintenance, security reasons or circumstances beyond our control.

7. Our content and intellectual property

The Website's design, text, guides, graphics, logo and the name "MediaToolNest" belong to MediaToolNest or its licensors and are protected by intellectual property laws. You may link to our pages and quote short excerpts with attribution and a link to the source. You may not copy, republish or redistribute our content in substantial part without our written permission.

The Service uses open-source software, including FFmpeg and FFmpeg.wasm. This software is provided under its own licenses, which are listed on our Open-Source Notices page. Nothing in these Terms limits your rights under those licenses.

8. Third-party links

The Website may contain links to third-party websites or resources. We do not control them and are not responsible for their content, policies or practices.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that results will meet your expectations. See also our Disclaimer.

Always keep a copy of your original files. We never receive your files, so we cannot recover an original or a result.

10. Limitation of liability

To the maximum extent permitted by law, MediaToolNest will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits, revenue or goodwill, arising from or related to your use of, or inability to use, the Service.

Because the Service is provided free of charge, and to the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to 50 US dollars (or the equivalent in your local currency).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, gross negligence or, where applicable, death or personal injury caused by negligence.

11. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless MediaToolNest from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your violation of the rights of others, including through files you process.

12. Suspension

We may restrict or block access to the Service, without notice, if we reasonably believe you have breached these Terms, are abusing the Service, or are creating risk or legal exposure for us or others.

13. Consumer rights

If you are a consumer, you may benefit from mandatory protections under the laws of the country or region where you live. Nothing in these Terms affects rights that cannot be waived or limited by contract, including rights under consumer protection laws in the European Union, the United Kingdom, Quebec and other jurisdictions.

14. Governing law and disputes

These Terms are governed by the laws of the place where MediaToolNest is operated, without regard to its conflict-of-laws rules. Subject to section 13, if you are a consumer, you may also be entitled to bring proceedings in the courts of your place of residence.

Before starting any formal proceedings, please contact us so we can try to resolve the issue informally.

15. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above, and we will highlight significant changes on the Website. Changes apply from the date they are published. If you continue using the Service after that date, the updated Terms apply to you.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, Cookie Policy, Copyright Policy, Disclaimer and Advertising & Affiliate Disclosure, form the entire agreement between you and us regarding the Service.
